Personal Information Protection and Electronic Documents

The purpose of this Part is to establish, in an era in which technology increasingly facilitates the circulation and exchange of information, rules to govern the collection, use and disclosure of personal information in a manner that recognizes the right of privacy of individuals with respect to their personal information and the need of organizations to collect, use or disclose personal information for purposes that a reasonable person would consider appropriate in the circumstances.

(b) it is reasonable to expect that the collection with the knowledge or consent of the individual would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province;
(c) the collection is solely for journalistic, artistic or literary purposes;
(d) the information is publicly available and is specified by the regulations
a) personal information consisting of the name, address and telephone number of a subscriber that appears in a telephone directory that is available to the public, where the subscriber can refuse to have the personal information appear in the directory;
(b) personal information including the name, title, address and telephone number of an individual that appears in a professional or business directory, listing or notice, that is available to the public, where the collection, use and disclosure of the personal information relate directly to the purpose for which the information appears in the directory, listing or notice;
(c) personal information that appears in a registry collected under a statutory authority and to which a right of public access is authorized by law, where the collection, use and disclosure of the personal information relate directly to the purpose for which the information appears in the registry;
(d) personal information that appears in a record or document of a judicial or quasi-judicial body, that is available to the public, where the collection, use and disclosure of the personal information relate directly to the purpose for which the information appears in the record or document; and
(e) personal information that appears in a publication, including a magazine, book or newspaper, in printed or electronic form, that is available to the public, where the individual has provided the information.
Organizations in the Province of Quebec Exemption Order
Whereas the Governor in Council is satisfied that An Act respecting the protection of personal information in the private sector, R.S.Q., c. P-39.1, of the Province of Quebec which is substantially similar to Part 1 of the Personal Information Protection and Electronic Documents Acta, applies to the organizations referred to in the annexed Order;
Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Industry, pursuant to paragraph 26(2)(b) of the Personal Information Protection and Electronic Documents Acta, hereby makes the annexed Organizations in the Province of Quebec Exemption Order.a S.C. 2000, c. 5
Any organization, other than a federal work, undertaking or business, that carries on an enterprise within the meaning of section 1525 of the Civil Code of Québec and to which An Act respecting the protection of personal information in the private sector, R.S.Q., c. P-39.1, applies is exempt from the application of Part 1 of the Personal Information Protection and Electronic Documents Act in respect of the collection, use and disclosure of personal information that occurs within the Province of Quebec.

 

How does DCAF use my information?


DCAF does occasionally share your name and address with affiliated organizations with whom DCAF has a common interest. DCAF employs persons and entities to perform functions on our behalf, such as fulfilling merchandise orders, sending mail and email, processing credit card payments or helping with the maintenance or set up of our servers or computers.  Such persons or entities have access to personal information needed to perform their functions, but may not use such information for any other purposes.
(a)A minister of the Crown and any department, branch, office, board, agency, commission, corporation or body for the administration of affairs of which a minister of the Crown is accountable to the Parliament of Canada may use electronic means to create, collect, receive, store, transfer, distribute, publish or otherwise deal with documents or information whenever a federal law does not specify the manner of doing so.


Collection, storage, etc.

A minister of the Crown and any department, branch, office, board, agency, commission, corporation or body for the administration of affairs of which a minister of the Crown is accountable to the Parliament of Canada may use electronic means to create, collect, receive, store, transfer, distribute, publish or otherwise deal with documents or information whenever a federal law does not specify the manner of doing so.

Electronic payment

A payment that is required to be made to the Government of Canada may be made in electronic form in any manner specified by the Receiver General.

Electronic version of statutory form

(1) If a provision of an Act of Parliament establishes a form, the responsible authority in respect of that provision may make regulations respecting an electronic form that is substantially the same as the form established in the provision, and the electronic form may be used for the same purposes as the form established in the provision.

Statutory manner of filing documents

(2) If a non-electronic manner of filing a document is set out in a provision of an Act of Parliament, the responsible authority in respect of that provision may make regulations respecting the filing of an electronic version of the document, and an electronic version of the document filed in accordance with those regulations is to be considered as a document filed in accordance with the provision.

Statutory manner of submitting information

(3) If a non-electronic manner of submitting information is set out in a provision of an Act of Parliament, the responsible authority in respect of that provision may make regulations respecting the manner of submitting the information using electronic means, and information submitted in accordance with those regulations is to be considered as information submitted in accordance with the provision.

Authority to prescribe form, etc.

(4) The authority under a federal law to issue, prescribe or in any other manner establish a form, or to establish the manner of filing a document or submitting information, includes the authority to issue, prescribe or establish an electronic form, or to establish an electronic manner of filing the document or submitting information, as the case may be.

Meaning of “filing”

(5) In this section, "filing" includes all manner of submitting, regardless of how it is designated.

Documents as evidence or proof

A provision of a federal law that provides that a certificate or other document signed by a minister or public officer is proof of any matter or thing, or is admissible in evidence, is, subject to the federal law, satisfied by an electronic version of the certificate or other document if the electronic version is signed by the minister or public officer with that person’s secure electronic signature.

Retention of documents

A requirement under a provision of a federal law to retain a document for a specified period is satisfied, with respect to an electronic document, by the retention of the electronic document if
(a) the electronic document is retained for the specified period in the format in which it was made, sent or received, or in a format that does not change the information contained in the electronic document that was originally made, sent or received;
(b) the information in the electronic document will be readable or perceivable by any person who is entitled to have access to the electronic document or who is authorized to require the production of the electronic document; and
(c) if the electronic document was sent or received, any information that identifies the origin and destination of the electronic document and the date and time when it was sent or received is also retained.

DCAF does not otherwise sell, share or disclose personal information with persons or entities not affiliated with or employed by DCAF except with your consent or when we reasonably determine it is necessary to do so in order to comply with the law or protect the safety, property or legal rights of DCAF or others. 
When you create a profile or register with the Sites, you become a registered user with password access and we use your Profile Information to verify your identity, create your user account, and help us to offer you more personalized features, improve our Sites, and provide you with information that is of the most interest to you.  Such Profile Information is also compiled and analyzed on an aggregated basis that does not reveal your personal identity ("Aggregated Data"). addition, you may from time to time be provided with or given the opportunity to obtain additional information of interest, updates, surveys, bulletins or other communications from DCAF or its partners ("Communications") via e-mail.  You may select to opt out of future Communications by following the opt-out provision below. 

 

How does DCAF protect my information?


DCAF and/or its subcontractors institute various electronic and administrative safeguards to protect your information from unauthorized access, including firewall technologies to help protect your data from hackers and other unwanted visitors.  Also, access to the Profile Information contained in your account is protected by use of a password, so keep your password private and secure.  In the event that we collect your credit card information, we will additionally utilize Secure Sockets Layer Software to encrypt your credit card information you input.  Despite use of these safeguards, there are inherent risks in transmission of electronic information.  We cannot guarantee and do not represent that your information will always be secure from unauthorized access. 
We also may use a managed hosting provider and/or other subcontractors to assist us with the provision and maintenance of the Sites.  If we do, we will impose on such provider confidentiality obligations for the treatment of information. 
 

How can I correct and/or update my data?


You may update and/or correct your Profile Information at any time by logging into your account and then adding and/or deleting any information, as desired or necessary. 

What about the privacy policies of sites linking to the Sites or to which the Sites link?

We provide links on our Sites to other web sites provided by third parties.  In addition, some users access our Sites via another site or a link on another site.  We have no control over the sites that link to our Sites or to which our Sites link.  We are not responsible for the privacy practices or the content of any site other than our Sites.  The existence of a link between our Sites and other third party sites does not imply an endorsement of these other sites.  We are not responsible for the content of such other sites, nor for the treatment of personal information you might provide while visiting such other sites. 

Notice to Parents Regarding Participation of Children and Teens.

We want to help you guard your children's privacy.  In order to comply with the Children's Online Privacy Protection Act, DCAF will not knowingly accept "personal information" from children under the age of thirteen (13) through the Site profile and registration procedures.  Our refusal to accept this information does not preclude minors, however, from visiting and using certain features of the Site.  In instances where personal information about children is collected so they can participate in programs offered on the Sites, the rules of this Privacy Policy will apply and DCAF will obtain verifiable parental consent before knowingly collecting such information from a child under the age of thirteen.  Parents will have the option of agreeing to the collection and use of the information and also to the disclosure of such information to third parties.  DCAF will not require a child under the age of thirteen to provide more information than is reasonably necessary to participate in an activity as a condition of participation. Parents can review their child's personal information, ask to have it deleted and refuse to allow any further collection of use of their child's information.  A parent wishing to do so should contact DCAF through the contact information set forth below.

Children’s Online Privacy Protection Act

When contests or clubs are directed at children, vendors may collect children's personal information without parental consent and communicate directly with those children, when vendors:
DCAF shall not use or disclose personal information of children without the express, verifiable consent of their parents or guardians, except as provided below.

When seeking parental consent, vendors shall clearly specify the nature of the proposed communications, the personal information being collected and all potential uses of the information.

(a)retain the information only as long as the children remain members of the club or until the conclusion of the contest; and DCAF athlete promotion or volunteer.

What constitutes my acceptance of this privacy policy?

By using the Sites, you expressly consent to the use and disclosure of information as described in this Privacy Policy.  Your continued use of the Sites after the effective date of any modification to the Privacy Policy will be deemed to be your agreement to the changed terms.  You agree to review the Privacy Policy each time you use the Sites so that you are aware of such modifications.
